Welcome to Universal Rackets. We look forward to working with you. This form must be completed and understood before commencing any tennis/pickleball classes or related activities. This agreement is between Universal Rackets, and the individual (referred as "member" hereafter) listed below.
Note: if individual is under the age of 18 a parent will sign this acting on the individual's behalf.
For and in consideration of Universal Rackets permitting me to enroll in and participate in tennis/pickleball classes or related activities (collectively, the "Activity"), by signing below, I hereby voluntarily indemnify, release from liability, and hold harmless Universal Rackets, its owner(s), agent(s), and contractor(s) (collectively, "Universal Rackets") for any accident, injury, illness, death, loss, damage to a person or property, or other consequences suffered by me or any other person arising or resulting directly or indirectly from my participation in the Activity, including claims arising from Universal Rackets' negligence. If I am injured, I agree to assume any financial obligation, either through my personal health insurance or some other means, for any medical costs I incur. Universal Rackets assumes no responsibility for any medical expenses, injury, or damage suffered by a participant in connection with the use of any Universal Rackets facilities/locations or services related to the Activity, regardless of where such services take place. I further agree to conform to all rules and regulations adopted by Universal Rackets and/or any other facility/location at which the Activity takes place (e.g., tennis/pickleball courts, facilities, public parks, public facilities, private locations). By signing below, I intend to expressly assume all risk of personal injury, death, or property damage upon myself, to the exclusion of Universal Rackets and any of its contractors, and to exempt and relieve Universal Rackets from liability for personal injury, property damage, or wrongful death. If tennis/pickleball classes are provided at a private residence or location, I agree to hold the owner of such residence, as well as Universal Rackets and its contractors and owner(s), additionally harmless from liability, loss, or damage arising at such residence or location. I agree that neither I nor my spouse, assignees, heirs, guardians, and/or legal representatives will make any claim against, sue, or attach the property of Universal Rackets and/or any owner or agent thereof for any loss or damage resulting from my participation in the Activity. I am aware of the potential dangers incidental to the activity, that this is a release of liability, a waiver of my legal right to collect damages in the event of injury, death, or property damage, and a contract between myself and Universal Rackets, and I voluntarily sign this document.
All sales for clinics are final. If you cannot make the clinic you will be still charged for it. You are allowed to have a friend sub for it. Note: the substitute participant must meet the age/level requirement. If they do not, they will be asked to leave and will be charged the full amount. Sessions canceled due to rain will be rescheduled for a future date. Sessions are not canceled until it is confirmed by Universal Rackets. In the event of rain during the class: all sessions lasting at least 1/2 the total time of the clinic time (determined and confirmed by the instructor) will be counted as a full session and not made up. In an event of rain: the rescheduling date will be attached to the end of the session. Example: if the session is June 7th-July 18th every Sunday, the rain date would be Sunday July 25th. If more than one cancellation due to rain occurs or if a makeup date cannot be added to the end of the session for any reason, Universal Rackets has the right to reschedule the clinic makeup any time/day as long as 5 days advance notice is given via email. If participants can not make the rain makeup date, Universal Rackets is not responsible for making any additional makeup, refund or accommodation. Universal Rackets reserves the right to modify the start time 1.5 hours from the original scheduled time of clinic. In an event of a participant getting injured in/outside the clinic and is unable to participate for any reason, all sales are final. If a participant signs up for the wrong level and Universal Rackets for any reason cannot make a change, all sales are final. Any accidental sign ups, incorrect level or any type of transfers will result in a $10 processing fee. For sessions/tournaments/and packages (sign up in advance) all sales are final. All session package sales are considered final and are valid for 12 months; after 12 months the package is assumed complete. Universal Rackets abides by a 10 day notice policy for all camps/clinics/and tournaments. If 10 days notice is not given, the participant will be charged the full amount and not issued a refund. All sessions start at the scheduled time. If you are late, Universal Rackets is not obligated to provide additional time.
I understand that photos or videos may be taken during the course of my involvement during Universal Rackets, which may be used for promotional purposes.
By signing this waiver, you acknowledge that it is your responsibility to ensure you receive all necessary information regarding our programs, including dates, times, and any other pertinent details. This information is typically provided via email, and we make every effort to ensure its delivery to your provided email address. You agree to check your email, including spam or junk folders, for any communication from Universal Rackets. If you do not receive an email or require further clarification about any aspect of our programs, it is your responsibility to promptly contact us. Failure to receive or read emails, for any reason: including those that may have been marked as spam or sent to your junk folder, wrong email provided, etc. will not be considered grounds for a refund or rescheduling. We highly recommend adding our email address to your list of safe senders to ensure you receive all important communications. All transfers, adjustments, requests, or any program-related modifications will only be acknowledged and responded to if they are made via email to [email protected]. Universal Rackets is not responsible for any requests, changes, or modifications made through any non-recognized communication channels including but not limited to: social media platforms, phone calls, text messages, or any other forms of communication.
Members who do not observe Universal Rackets rules and regulations or who abuse equipment in any fashion will be asked to leave. The management reserves the right to terminate membership of anyone who refuses to observe any of Universal Rackets rules or regulations. Not all rules and regulations are listed in this agreement. Universal Rackets reserves the right to add, change or remove rules, conditions of membership, opening and closing hours, and all services and facilities offered by Universal Rackets. Member has read, and fully agrees to the term of this Agreement and understands and agrees that by signing this Agreement (which contains a waiver, release and assumption of risks) Member has given up considerable future legal rights. Member has signed this Agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older/or acting as the parent of member and mentally competent to enter into this Agreement.
